Save More Than 2000 Kilometers of Running—Dalian Maritime Court Successfully Completed the First Cross-provincial Case Filing

Cross-jurisdiction case filing means that a party or an agent ad litem submits filing application to a court with jurisdiction in another place by selecting the nearest litigation service center of the people’s court which provides corresponding filing and registration litigation services. The cross-jurisdiction case filing work is the vivid practice and concrete embodiment of the tenet of people-oriented justice, as well as the reflection of the “people-centered” idea in the judicial field. On August 19, a maritime lawsuit was successfully filed between Dalian Maritime Court and Ningbo Maritime Court.

An agent of a shipping fuel sales co.,Ltd in Dalian filed an application for maritime claims registration in the litigation service center of Dalian Maritime Court. The defendant is located in Nantong, Jiangsu province. After examination, the filing judge of Dalian Maritime Court found that the case should be under the jurisdiction of Ningbo Maritime Court. After explaining it to the lawyer and obtaining his consent, the filing judge immediately started the procedure of cross-jurisdiction case filing. The filing judge first used the mobile phone to take photos of the information of the party and the agent ad litem, entrusted procedures, relevant evidence and other materials provided by the plaintiff, and sent these photos to Ningbo Maritime Court through the cross-jurisdiction case filing platform of China mobile micro-court. After Confirming the case was approved to be filed and the plaintiff received Ningbo Maritime Court’s electronic “Notice for Case Acceptance”, the filing judge, according to the feedback opinions of Ningbo Maritime Court concerning the case acceptance, guided the plaintiff to fill in “Confirmation of the Party on Address for Service”, “Receipt of Service”, “Letter of Commitment for Action” and other legal documents, and informed the plaintiff of related payment and litigation rights and obligations. Subsequently, the case paper file was transferred to Ningbo Maritime Court through the court express. From the case-filing judge receiving the lawsuit materials to the plaintiff receiving the “Notice for Case Acceptance”, Dalian Maritime Court and Ningbo Maritime Court jointly completed the cross-jurisdiction case filing work.

Dalian Maritime Court tried hard to make use of data to serve people’s litigation efficiently. Relying on the achievements of the construction of the smart court, Dalian Maritime Court fully implemented the spirit of the central conference on political and legal work and the forum for presidents of the national higher courts presided by the Supreme People’s Court and actively explored the work of cross-jurisdiction case filing. After realizing the full coverage of cross-jurisdiction case filing of maritime cases in the whole three provinces of northeast China in mid-May, Dalian Maritime Court successfully accomplishes the cross-jurisdiction case filing of maritime litigation with Ningbo Maritime Court today, which is also the first case of cross-provincial case filing in Liaoning court system. Next, on the basis of consolidating the existing achievements of cross-jurisdiction case filing, Dalian Maritime Court will accelerate the exploration of cross-jurisdiction coordinated case filing service and push forward the cross-jurisdiction case filing with other courts inside or outside Liaoning province.

Dalian Maritime Court will seize every opportunity to strengthen the in-depth application of information technology, innovate new measures to serve people and deepen Cross-jurisdiction case filing work.
