Our Judge was Invited to Attend the Forum of Shanghai International Shipping Law (2019)

On November 26, 2019, the forum of Shanghai International Shipping Law (2019) was held in Shanghai, and Sun Guang, member of the party leadership group and vice president of our court, was invited to attend the forum.



This forum is co-sponsored by East China University of Political Science and Law and Shanghai Maritime Court. At present, the revision of the Maritime Code of the People’s Republic of China (hereinafter referred to as the Maritime Code) has entered a critical stage, and the revision of the Special Maritime Procedure Law of the People’s Republic of China (hereinafter referred to as the Special Maritime Procedure Law) has also been started. The purpose of this forum is to draw on the latest achievements in the theoretical research on international maritime legislation and maritime law, summarize China's practical experiences in maritime justice over the past 35 years, effectively promote the revision of the Maritime Code and the Special Maritime Procedure Law, and build a maritime legal system with Chinese characteristics in the new era. Nearly 100 senior judges, experts and scholars, maritime lawyers and shipping practitioners attended the forum.

This forum is divided into “the trends in international maritime legislation and the revision and improvement of the Maritime Code” and “the development of maritime judicial practice and the revision and improvement of the Special Maritime Procedure Law”. The guests made a speech on the related topics respectively and had in-depth and detailed discussions with each other on the issues concerned.

In the first topic of the forum, Sun Guang, vice president of our court, was invited to deliver a keynote speech titled by The Study on the Trial Practices of Contract of Carriage of Goods by Sea. She began with the three typical cases of contract of carriage of goods by sea disputes, induced the legal issues, focused on the disputes, and made a profound but simple analysis on the theoretical and practical difficulties and issues in dispute, such as, the validity of a notice by the obligee to assign its rights while exceeding the limitation of time, the claim of container demurrage at the port of destination when the consignee refuses to take delivery, and the shipper’s claim right for the goods damage when the goods is returned. In the form of trial experience, she demonstrated “the attitude of Dalian Maritime Court”, and put forward constructive suggestions for the revision of the Maritime Code.


  

Dalian Maritime Court will pay sustained attention to the revision work of the Maritime Code and the Special Maritime Procedure Law, and actively utilize judicial practice as a platform to dedicate judicial practice experience and wisdom to the law revision, jointly commit to build a perfect maritime and admiralty law system and scientific maritime and admiralty judicial system with related walks of life, strive to serve the social and economic development in our country, and promote the strategy of maritime power.
