"Ten commitments of litigation service" are released

On the afternoon of December 3, 2020, Dalian Maritime Court held a press conference on the construction of law-based business environment and released "ten commitments of litigation service" to the public. A number of media and representatives from Liaoning and Dalian People's Congress, CPPCC members, Ship-owners Mutual Insurance Association, insurance enterprises, port and shipping enterprises, lawyers and other aspects attended the press conference.

President Deng Yan, also secretary of the Party group, briefed on the development of the law-based business environment of the Court. Deng Yan said that the release of ten commitments of litigation service was a solemn promise made by the Party group to the provincial Party committee, and a solemn promise made by the whole Court’s police officers to the people and various market entities.


Wu Hanshuang, deputy chief judge of the Case Filing tribunal, issued the "ten commitments of litigation service" and made specific explanation.

1. Reception: accept immediately with the first inquiry accountability;

2. Indictment: online and self-service;

3. Dispute resolution: litigation guidance and multiple dispute resolution;

4. Filing: one-time and cross-jurisdiction registration;

5. Trial: fair and open and take the initiative to answer questions;

6. Documents: fully reason and print inside and outside the court;

7. Enforcement: comprehensively inspect and control and take appropriate measures;

8. Foreign-related Affairs: English service and equal treatment;

9. Complaint: smooth channel and no shielding mistakes;

10. Service: intelligent and intensive and convenient and efficient.


"Accept immediately with the first inquiry accountability" means once the parties enter the court, the litigation guide will receive him or her in no time and contact the relevant personnel immediately. If the judge attends a court session or goes out to perform duties, the litigation guide will continue to guide the docking personnel, and there will be no situation where the parties are ignored or kept inquiring around.


"Online and self-service" means that the parties can not only file a lawsuit in the filing window, but in Liaoning litigation service network, mobile micro court and self-service filing machine, so as to reduce the litigation cost of the parties as much as possible. The Litigation Service Center is equipped with modern equipment such as litigation risk assessment, information inquiry system and self-service printer, providing one-stop service for the parties to inquire relevant laws, evaluate litigation results and prepare litigation materials.


"Litigation guidance and multiple dispute resolution” means that the Court and six other institutions including Dalian People's Mediation Center jointly provide mediation, litigation, arbitration and other means to resolve disputes between the parties, and provide litigation guidance for the parties, so that the parties can choose the optimal dispute resolution method according to their own situation.


"One-time and cross-jurisdiction registration" means that the Litigation Service Center provides the list of filing materials, and the cases in line with the legal provisions must be handled and accepted, and the cases that need to be supplemented or modified must be conducted with one-time notification, and online payment service is provided, and a lawsuit can be filed to any domestic court in the filing window of the Court, and the parties can also file a lawsuit to the Court in the other courts.


"Fair and open and take the initiative to answer questions" means that the trial procedure is standardized, and the entity is fair, and all the cases heard in public according to law are broadcast live in China Court Trial Online, and the trial information is timely recorded in the process of litigation to facilitate the parties to inquire about the progress of the case and consult the case file materials, and when the judgment is issued, the presiding judge takes the initiative to answer questions and solve doubts.


"Fully reason and print inside and outside the court" means that every judgment should be full, accurate and clear in reasoning, so as to ensure every judgment result justified. The Litigation Service Center has set up an all-in-one machine for the output of judgment to provide the parties with the service of receiving and printing other court judgments.


"Comprehensively inspect and control and take appropriate measures" means to complete the tasks of inquiry, sealing up, seizure, freezing, property disposal and case payment in strict accordance with the legal deadline. In the case that the applicant cannot provide the property available for enforcement, the enforcement judge shall find out the property available for enforcement online and offline within one month.


"English service and equal treatment" means that the staff at the Litigation Service Center can receive foreign parties in English, and the English litigation guidelines and typical cases are published on English websites, and the Court tries the foreign-related disputes fairly, protects the legitimate rights and interests of Chinese and foreign parties equally and enhance China's international judicial authority and credibility.


"Smooth channel and no shielding mistakes" means to smooth the channel for the parties to reflect the problem, open the complaint window on the official website, set up the president's e-mail box in the litigation service hall, and the parties can leave messages in text and voice. The Court will seriously investigate the problems reported by the masses, deal with them seriously and never tolerate them.


"Intelligent and intensive and convenient and efficient" refers to the intelligent and intensive management of the litigation affairs and the standardized and efficient services for the parties in all aspects by fully relying on the construction of smart court such as smart litigation service, smart trial, smart enforcement, smart government and smart management. The litigants can handle litigation matters on the mobile phone, computer, telephone and self-service equipment. The Court will provide the self-service litigation all the time and truly make the data work more and the masses run less errand.


The deputies from the Case-filing Adjudication Tribunal, the Maritime Adjudication Tribunal and the Enforcement Bureau answer questions from the media reporters and deputies to the National People's Congress on the safeguard measures of the ten commitments, the operation of the diversified dispute resolution mechanism, the enforcement of property investigation and control, cross-jurisdiction case filing and document printing inside and outside the Court.


The press conference was presided over by Chang Zhongyan, member of the Party group and vice president of the Court.
